SMS/MMS Messaging Policy

Purpose

This Policy describes how Darrell A. Johnson, Attorney at Law uses text messaging and the standards we follow to protect recipients and comply with applicable laws and industry guidelines (e.g., TCPA, CTIA Best Practices).

Program Types & Use Cases

  • Transactional: appointment confirmations, reminders, schedule changes, and responses to your inquiries.
  • Service updates: non-marketing notices relevant to your matter or requested information.
  • Marketing (optional): sent only with express consent; opt-out anytime.

Message frequency varies. Message & data rates may apply.

Consent & Opt-Out

  • We obtain clear consent before sending messages, typically via a checkbox on our Contact page or by your texting JOIN to our number. (Opt-in data will not be shared with third parties.)
  • Reply STOP to cancel; HELP for help. We honor opt-outs promptly and log consent/opt-out events for audit.
  • Consent is not required to receive legal services.

Prohibited Content

We do not send content that is illegal, harmful, or prohibited by carriers, including but not limited to:

  • Hate, harassment, or threats; incitement to violence; explicit or pornographic content.
  • Illicit drugs and federally illegal substances; instructions for illegal activities.
  • Deceptive, fraudulent, or phishing content; spam or snowshoe messaging.
  • Gambling or high-risk financial schemes; sale of weapons or regulated goods without authorization.
  • Unlawful collection or sharing of personal data.

As a law firm, our messages are informational and professional; we avoid case-specific details over SMS unless you request and consent.

Quiet Hours & Cadence

We aim to send messages during business hours (Mon–Fri, 9:00am–5:00pm ET) unless time-sensitive or requested otherwise. We avoid excessive frequency and allow you to set your preferences.

Data Handling & Security

  • We collect your mobile number, message content, timestamps, and delivery metadata to operate the Program.
  • We use reputable messaging providers and apply reasonable technical and organizational safeguards.
  • We retain data only as long as necessary for operations, recordkeeping, and legal/ethical obligations, then delete or de-identify it.

Carriers & Delivery

Delivery may depend on carrier networks and device settings. Carriers are not liable for delayed or undelivered messages. If you experience issues, reply HELP or contact us at privacy@dajohnsonlaw.com.

International Messaging

The Program is intended for U.S. numbers. International delivery is not guaranteed and may incur additional charges.

Reporting Abuse or Errors

If you believe a message from us is spam or was sent in error, forward it to privacy@dajohnsonlaw.com and include your number. We will investigate and correct promptly.

Changes to this Policy

We may update this Policy to reflect changes in law, carrier rules, or our practices. We will post the updated Policy with a new effective date.
